Know all men by these presents: That Thomas Haynes and Edward M. Glenn in the year 1845 became the joint purchasers at assessor’s sale for public taxes of a certain portion of a survey of land granted to Ramon Musquiz, situated in said county on the west side of the Lavaca River, it being the balance of said original survey not heretofore conveyed to said Glenn.
The said sale was the property of Joseph M. Coddington, and whereas the said assessor made a deed for the same to Thomas Haynes alone instead of to said Haynes and Glenn jointly, and whereas the said Haynes and Glenn have this day divided the same and settled their respective interests in the same, this instrument witnesses that in consideration of the promises and to carry out their original and present agreements, that said Haynes has and does by these presents, bargain, sell, release, and quit claim to the said Glenn all that part of said survey lying within the following boundaries, to wit:
Beginning at the lower corner of said original survey on the Benow Creek (actually, Venadito or Venado Creek);
Running thence South 28° 10’ West 7,450 varas (6,898 yards) to a black or live oak 14 inches in diameter standing on the north bank of the Garcitas Creek, it being the lower corner of Garcia’s survey;
Thence down said creek with its meanders to the mouth;
Thence along the shore of Lavaca Bay to the mouth of the said Venado Creek;
Thence up said creek with its meanders to the place of beginning, supposed to contain some 3,000 acres, more or less.
Also, that other portion of original survey, to wit:
Beginning on the east bank of said Venado four hundred (400) varas (370 yards) below the mouth of a certain ravine or gully that puts into the said Venado on the north side thereof, some hundred (100) varas (93 yards) above the present crossing on said Venado;
Thence in a northeastern direction until it strikes the southeast corner of a survey made for James P. Stone, it being an elm standing on the brow of the bluff;
Thence with the said Stone’s line westward to the southwest corner;
Thence with said line northward a sufficient distance so that a line running westward to the rear line of the original survey,
Thence with said original line to the corner on the Venado on post oak and down said creek to beginning point 400 varas below the mouth of said ravine, may include an area of 3,000 acres.
To have and to hold the aforesaid described parts or parcels of land to the said Edward M. Glenn, his heirs and assigns forever free from the claim of the said Haynes, his heirs and assigns and of all other claims by through or under him. In testimony whereof the said Haynes has hereto set his hand and seal using scrawl for seal this 23rd August 1850.
