Book E Page 626 Thomas Haynes Gives 1,280 Acres to His Son Daniel

Note: Taken literally, as it should be, the upper line running “southwestwardly to a small mott” runs S 45° W, just as the original outer boundary lines of the Haynes place did. However, James M. Stanton’s upper line runs S 50° W, so the upper and lower lines are not parallel. The back line is supposed to be at right angles to the upper line. The distance that the property had to extend SW out into the prairie just happens to appear to coincide with the present road (FM 234), but that is strictly a coincidence – the road came later. The lower 640 acre tract eventually had to be resurveyed after it was given to Christopher.
We think we have a good handle on the location of the beginning point in the description (… mouth of a ditch near the former saw mill), so the map should be pretty close to being correct.

Deed of Gift:
This indenture made and entered into this 8th day of August, 1857, between Thomas Haynes of the one part, and Daniel Haynes of the other part, WITNESSETH: that in consideration of the love and affection which the said Thomas Haynes hath and beareth unto the son Daniel Haynes (his son), the said Thomas hath this day and does by these presents give, grant, and convey unto the said Daniel Haynes, a certain tract of land situated in the County of Jackson, State of Texas, on the west side of the Lavaca River, being a part of the Ramon Musquiz, five and a half league survey, and bounded as follows:
Beginning on the river at the mouth of a ditch and near to the place where Platt’s Steam Saw Mill formerly stood;
Thence with said ditch (a straight line) to its termination near the base of a sand mound;
Thence southwestwardly to a small mott on the bluff;
Thence pursuing the same course that a line at right angles will intersect James M. Stanton’s upper line, and with that line to the river;
And thence up the river to the beginning, will include the area or quantity of twelve hundred and eighty (1,280) acres.
To have and to hold the above described land with the appurtenances to the said Daniel Haynes, his heirs, and assigns forever, free and clear from the claim of him the said Thomas Haynes, his heirs and all others claiming by, through, or under him or them.
In testimony whereof he hath hereunto set his hand and a scrawl for seal the day and year aforesaid.
