Whereas at a regular term of the Honorable County Court held at the courthouse in and for the county and state aforesaid, on the 27th day of November A.D. 1866, the following Order was had and decreed, to wit:

In the matter of this estate, comes H. D. Starr, guardian of the estate of Mary, Robert, and Eliza Schneider, minors, and makes application for leave to purchase certain real property from the estate of Thomas Haynes, deceased, in payment of a debt due by said Haynes to the estate of said minors, and it appearing to the Court that the interest of said wards will be advanced by said purchase, it is therefore ordered and decreed, that the said Henry D. Starr, guardian, be and is hereby authorized to make purchase aforesaid, “Vide Minute Record C pages 344 & 345” of said Court.
And now therefore, know all men by these presents: That I, Christopher Haynes, executor of the last will and testament of my father, Thomas Haynes, deceased, for and in consideration of the sum and amount of twenty-one hundred and twenty-four 70/100 dollars ($2,124.70) and interest thereon from the 8th day of May A.D. 1866 (the day and term of the approval of said account by said court), to me in hand paid, released, annulled, and given up by said Henry D. Starr, guardian as aforesaid, the receipt and justness and equity whereof is hereby fully acknowledged, allowed, and confessed, and full acquittance for the same, in every way given by the various parties herein named, the same being fully and entirely and by this deed satisfied, annulled, and paid, have granted, bargained, sold, enfeoffed, conveyed, and confirmed, and by these presents do grant, bargain, sell, enfeoff, convey, and confirm unto the said Henry D. Starr, guardian of the Estates of Mary, Robert, and Eliza Schneider, minors, for the use and benefit of his said wards, all of the following tract or parcel of land, to wit:
A part and portion of the five and a half leagues of land granted originally to Ramon Musquiz by the Spanish government and lying and being on the western side of the Lavaca River, in the County of Jackson in the State of Texas. The tract of land herein conveyed, lying at the mouth of said river or thereabouts and known as “the forks tract” (actually, not the mouth, but upstream where the Lavaca and Navidad meet), and bounded as follows:
Beginning for the lower corner of this tract at the upper corner on the banks of the Lavaca River, and on its western side of a tract of land sold by Thomas Haynes to Daniel R. Coleman on the 21st day of February A.D. 1851;
Thence with said Coleman’s line to the head of the bayou to said Coleman’s corner in a lake or pond, which it enters;
Thence to the corner of land sold to James M. Stanton and back corner;
Thence along Stanton’s side lines on the lower side thereof for the upper line of this tract, to Stanton’s lower corner on the bank of said River;
Thence down the river with its meanders to the place of beginning, so as to include all the land between the lands of James M. Stanton, James J. Stone, and Daniel R. Coleman as aforesaid, being 800 or 900 acres more or less.
To have and to hold the same of Henry D. Starr, guardian, as aforesaid, for the use of said minors, Mary, Robert, and Eliza Schneider, and to his and their sole use, benefit, and behalf in fee simple forever. Hereby fully guaranteeing and warranting the title to the same to him and them as against me and my heirs and the heirs of the estate of Thomas Haynes, deceased, and against any and all and every person or persons legally claiming or to claim the same or any part thereof.

Before me, Geo. F. Simons, Clk. County Court of said County personally came and appeared Christopher Haynes Executor of the Estate of Thos. Haynes decd. to me well known who signed the above instrument of writing in my presence and duly acknowledged the same to be his act and deed and declared that he signed sealed and delivered the same for the purposes and considerations therein stated. To certify which I hereunto sign my name and affix the seal of the County Court of said County at my office in Texana, this 8th day of December A. D. 1866.
