Know all men by these presents that we, Celia A. Haynes and Amos Haynes, of the aforesaid state and county, for and in consideration of the sum of one dollar, cash to us in hand paid by George Menefee, Jr. of the aforesaid county and state, and also for the further consideration hereinafter agreed, to wit:
One-half interest in and to the fences erected by the said George Menefee, Jr. between and along the line of the lands owned by him, the said Menefee, and those of the said C. A. Haynes and the said Amos Haynes, the receipt of which said consideration named above is hereby fully acknowledged, have this day granted, bargained, and sold, and by these presents grant, bargain, and sell, alien, release, convey and confirm unto him the said Geo. Menefee, Jr. and to his heirs and assigns, all and singular, that certain piece, parcel, or tract of land, lying and being situated in said County of Jackson, State of Texas, and being a part of the Ramon Musquiz grant, and more particularly described as follows, to wit:
Beginning at the SW corner of a tract of six hundred and twelve (612) acres of land sold by Thomas Haynes to James M. Stanton, as will appear from the deed of record in the office of the clerk of the court, Jackson County, Book “D”, page 136;
Thence southwardly with the line to a tract of five hundred (500) acres sold by said Thomas Haynes to James M. Stanton, as will fully appear from deed on record in the office of the clerk of the court, Jackson County, Texas, Book “E”, page 347 and 348;
Thence southwardly (should be southwestwardly) with the line of said tract to the north line of a tract of one thousand (1,000) acres sold by said Thomas Haynes to James J. Stone, as will appear by reference to deed recorded in the said clerk’s office, Book “D’, page 154;
Thence west with said line to the NW corner of said 1,000 acre tract;
Thence North 43° E (magnetic course, or without allowing any variation for the compass), to the place of beginning;
Containing an area of one hundred and thirty eight acres more or less (138 acres).
To have and to hold the aforesaid tract or lot of land so described unto him the said Geo. Menefee, Jr. and to his heirs and assigns forever, for the considerations aforesaid, and we the said parties of the first part, do hereby promise and agree to and with the said party of the second part, that we will forever warrant and defend the title to the said granted and bargained land and premises unto him the said Geo. Menefee, Jr. and to his heirs and assigns forever, for the consideration aforesaid. And we the said parties of the first part, do hereby promise and agree to and with the said party of the second part that we will forever warrant and defend the title to the said granted and bargained land and premises unto him the said Geo. Menefee, Jr., his heirs, assigns, or legal representatives, free from the claim of us and our heirs and from all and every other person or persons whomsoever claiming or to claim the same or any part thereof.
And it is especially agreed between the parties hereto that neither party shall have the right to move the said fences so erected without the full and free consent of the other party so desiring such removal.
