Articles of agreement made and entered into by and between Mrs. Celia Haynes of the County of Jackson in the State of Texas, party of the first part, and Adams Webb, party of the second part of the State and County aforesaid:
Witnesseth:
The party of the first part for the considerations hereinafter set forth has turned over to him the said party of the second part a certain stock of female meat cattle numbering one hundred and seventy (170) head in the following mark and brand to wit, Brand thus CH and marked thus (ear marks showing cropped and undercut on the right ear). The said party of the first part gives to the party of the second part exclusive control over said cattle for the space of five years next succeeding the date of these presents, during which period of time said party of the second part shall have the sole right to sell and dispose of any of the male cattle that are of the increase of the female cattle hereinbefore mentioned, retaining one half of the proceeds thereof, and paying over to the party of the first part the remaining one half of said proceeds, and at the expiration of the five years aforesaid, the increase of said cattle to be equally divided between the parties hereto, each party to receive one moiety (legal term for “half”) of the whole of the said increase.
The said increase of said cattle so turned over to said Webb as aforesaid to be branded and marked as follows to wit: Brand F+ and mark thus (ear marks showing a notch on the end of the left ear and a crop of the right ear). And the said party of the second part covenants and agrees to give the said Cattle his best attention and care for them in the same manner as though all of them were his own for the term of five years from the date hereof, to furnish at his own expense sufficient pasturage for same with plenty of water and winter protection so that they will not suffer for the want of either, and to brand and mark all of the increase in the said brand F+ and mark (ear marks same as above), to attend to the selling and disposing of such of the male increase as it may be deemed advisable to sell, taking one half of the said proceeds from such sale or sales and paying the other half without any deduction to the party of the first part, and at the expiration of the said five years to deliver to the said Party of the first (part) her heirs or assigns, all of the original cattle received from her as aforesaid which have not in the meantime died and also one half of said increase.
It is distinctly understood between the parties hereto that neither party shall have the right to sell or dispose of any of the original cattle nor the female increase thereof during the time in which this agreement is to run, and all of said original cattle remaining alive at the end of five years from the date of these presents together with one half of the increase thereof are to be returned by the said Webb to the said Celia Haynes and the only interest that the said party of the second part shall have therein for his care, attention, and furnishing pasturage shall be one half of all the increase thereof.

Owen, a Notary Public of Jackson County on this day personally appeared Adams Webb known to me to be the person whose name is subscribed to the foregoing instrument and acknowledged to me that he executed the same for the purpose and consideration therein set forth. And on the same day personally appeared H. G. Martin who after being by me duly sworn, on oath says that he saw Mrs. C. A. Haynes sign said instrument and he signed the same as a witness at her request.
