Know all men by these presents, that for and in consideration of the sum of Three hundred and eighty dollars ($380) cash to me in hand paid by M. C. Whalen, the receipt of which is hereby acknowledged and for the further consideration of the certain promissory note of M. C. Whalen and his wife Mary J. Whalen bearing even date herewith made executed and delivered and payable on or before the first day of August 1888 to the order of Amos Haynes in the sum of Six hundred and ninety one (691) dollars and bearing interest from date at the rate of ten percent per annum until paid.
I the said Amos Haynes of the County and State aforesaid have bargained, sold and conveyed and by these presents do bargain, sell, convey and deliver unto the said M. C. Whalen all of my interest in the stock of Cattle in Jackson County, Texas branded AH (a flowing A without a crossbar, with the bottom right of the A flowing up to the top of the H) my said interest being one half of said stock.
To have and to hold my aforesaid interest in the above described stock of cattle unto him the said M. C. Whalen, his heirs and assigns forever free from all claims and reservations of every kind whatsoever by me.
And I do hereby covenant and agree to and with the said M. C. Whalen, that I own an undivided one half interest in the aforesaid stock of cattle and have full power and right to sell the same, that my said interest is free from all encumbrances and further I bind myself, my heirs, executors and administrators to forever warrant ande defend the said cattle against the lawful claims of all persons whomsoever unto the said M. C. Whalen his heirs and assigns. The words “my heirs, executors and administrators” between the 14 and 15th lines of this page were interlined before signing.
