With Mary Julia Haynes Whalen
Note: Amos W. Haynes originally sold 700 acres of his Haynes place land to his oldest daughter, Mary Julia Haynes Whalen, as recorded in Book N, page 103. But here, that deal was effectively reversed when he gave her 770 acres of land he owned in the Juan Fernandez Grant in exchange for his original 700 acres of Haynes place land. This is the deed for the 770 acres; a separate deed returns the 700 acres to Amos. (The Juan Fernandez Grant land is immediately above the Ramon Musquiz Grant land.)

Know all me by these presents that I, A. W. Haynes of the county and state aforesaid, for and in consideration of the sum of one dollar to me in hand paid by M. C. Whalen, and other valuable considerations to me thereunto moving, the receipt of which is hereby fully acknowledged, have granted, sold, and conveyed, and by these presents do grant, sell, and convey unto the said M. C. Whalen of the County of Jackson and State of Texas, all that certain tract of land situated in Jackson County, Texas, on the west side of the Lavaca River which was conveyed by one John Machicek to me by deed bearing date of the 2nd day of August, 1889 and described as follows, to wit:
A part of the Juan Fernandez league, beginning at a wild peach in the west bank of the Lavaca River marked X, which is the upper corner of the lower quarter of Pumphry tract as surveyed by J. P. Duprey in the division of said league;
Thence S 45° W with north boundary line of said tract 6,280 varas to the back line of said league;
Thence N 45° W 957.5 varas with back line of said league to a stake, the SW corner of J. N. Pumprhy’s land;
Thence N 45° E 3,888.4 varas with the south boundary line of said Pumphry land to another stake, the NW corner of John Jimek’s survey of 300 acres;
Thence S 45° E with said Jimek’s western boundary line 645.5 varas to another stake in edge of spunk pond;
Thence N 45° E with said Jimek’s southern boundary line 1,727.6 varas, pecan tree 2.5 feet in diameter marked X and on SE and SW sides;
Thence with said Jimek S 45° E 306 varas to a stake 6 varas N 45° W from D. Dempsey’s north boundary line, it being the upper line of said lower or Pumphry quarter;
Thence N 45 E with said Jimek to a stake on the west bank of the Lavaca River;
Thence down the river with its meanders to the place of beginning, containing 770 acres of land more or less.
To have and to hold the above described premises together with all and singular the rights and appurtenances thereto in any wise belonging unto the said M. C. Whalen, his heirs and assigns forever, and I do hereby bind myself, my heirs, executors, and administrators to warrant and forever defend all and singular the said premises unto the said M. C. Whalen, his heirs and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof.
