Whereas I, Celia A. Haynes of the County of Jackson and state aforesaid but temporarily residing in said County of Victoria, did on the 18th day of November A.D. 1875, for and in consideration of the sum of one dollar to me paid by C. Haynes, and for natural love and affection, convey, grant, give, bargain, and sell unto the said C. A. Haynes, his heirs and legal representatives forever, six hundred and forty (640) acres of land out of the Ramon Musquez (or Musquiz) league situate in said County of Jackson and State of Texas; and whereas because of and by reason of defective and imperfect description of the field notes and land conveyed in said deed to said C. Haynes, difficulties have arisen in the surveying and proper location of said six hundred and forty (640) acres of land.
Now therefore, I, the said Celia A. Haynes for and in consideration of the sum of one dollar to me in hand paid by Annie Haynes, surviving wife of said C. Haynes, deceased, and Robert S. Haynes, Amos C. Haynes, and Mollie A. Haynes, surviving children and heirs at law of the said C. Haynes, and for the purpose of a full, clear, definite and more perfect description of the land conveyed by the deed above mentioned, do hereby substitute, adopt, ratify, accept, and make the following as the true field notes to said six hundred and forty acres of land, to wit:
Beginning at the NE corner of a survey of 612 acres sold by Wm. M. Sanford to George Menefee on the west bank of the Lavaca River (note: this is the land originally sold to James M. Stanton;
Thence S 50° W (no variation) with the NW boundary line of said survey, at 1,040 varas a large post oak tree marked (X over three hacks, or horizontal bars), at 2,140 varas (1,981 yards) a stake and corner of fence (and NW corner of said survey);
Thence S 44¼° W with said Menefee’s fence and line 1,910 varas (1,769 yards) to a stake in same;
Thence N 40° W 1,091½ varas (1,011 yards) to a stake in prairie;
Thence N 50° E 3,596 varas (3,330 yards) to a stake on said Lavaca River, from which a live oak 16 inches in diameter marked X bears S 34¾° W 130 varas;
Thence down the meanders of said river to the place of beginning, containing six hundred and forty (640) acres.
To have and to hold the above described premises unto the said Annie Haynes, Robert S. Haynes, Amos C. Haynes, and Mollie A. Haynes (in accordance with the respective rights and interests which they as heirs at law of said C. Haynes, deceased, had and possessed by virtue of the aforesaid deed from me to said C. Haynes) together with all and singular, the rights, members, and appurtenances thereto belonging or in anywise incident or appertaining and I do hereby bind myself and my heirs to warrant and forever defend all and singular the said premises unto the said heirs at law of said C. Haynes, deceased, against the claims of all persons whomsoever lawfully claiming the same or any part thereof.
