Final Report by Executor Christopher Haynes Regarding the Estate of Thomas Haynes
District Court, Jackson County
February Term 1876
Estate of Thomas Haynes, Deceased
C. Haynes, Executor
To Honorable W. H. Burkhart, Judge of the 20th Judicial District &c
C. Haynes, Executor of the Estate of Thomas Haynes, deceased, would respectfully report the condition of said Estate, as follows, to wit:
The will of Thomas Haynes, deceased, under which Executor has acted, required that no proceedings should be had in regard thereto except to file Inventory. Said will was duly probated and Inventory filed. It was believed at one time that the Estate was solvent; subsequently, however, it was known to be otherwise, on account of the casualties of war and consequent depreciation of the value of property and the total insolvency of debtors to the Estate. It became evident that the Estate could not pay the debits exhibited against, consequently, with the view to do Justice to all the creditors, proceedings were had in the Court to sell property and pay prorata to them of all the available funds that could be raised, which has been done.
Subsequently suit was instituted against Celia Haynes (widow of said Thomas Haynes) to recover certain stock of cattle alleged to be community property, and liable to the creditors. Said suit was determined at the last June Term of your honorable court by a compromise on an agreed Judgment, by which Mrs. C. Haynes was to pay $1,500.00 which has been paid over prorata to the creditors, and receipts in full against said Estate has been taken, and all claims and demands of said creditors against said Estate have been assigned to said Celia Haynes.
So far as I know and believe, all property and available assets belonging properly to the Estate of Thomas Haynes, deceased, has been appropriated to the payment of the creditors of said Estate prorata. There being nothing remaining of the Estate in the hands of the Executor and nothing further by him to do in the premises, he respectfully asks to be discharged from his trust as said Executor.
An account of receipts and disbursements and the Vouchers to sustain payments are herewith respectfully submitted for the action of your honorable court.
