Note: This deed was filed twice, but both were dated the same. The first deed did not include the signature of Robert S. Haynes, who probably lived in Bee County at the time. Both deeds failed to include the name of Robert S. Haynes in the “to have and to hold” section. This deed is interesting in at least two respects:
(1) it states that the road, now FM 234, was to run through the property of Robert S. Haynes and the Whalens, but along the dividing line between the land of Richard Daniel Haynes and his sister, Blanche Owens; and
(2) it states specific distances that can be used to locate the bottom line of the Robert S. Haynes land and the Richard Daniel Haynes land.
Note: Most names have been spelled out in full for clarity, rather than using only the initials as in the original recorded deed.
The State of Texas
County of Jackson
Know all men by these presents: That we, Will Owens and wife Blannie (Blanche) Owens; Richard Daniel Haynes; Robert S. Haynes; Mark Whalen and Michael C. Whalen, individually and as guardian of Lorraine Whalen, a minor; of the County of Jackson and State of Texas, for and in consideration of the sum of Ten ($10.00) Dollars, to us in hand paid by Jackson County, and for the purpose of getting a road established on the strip of land hereafter described and other considerations herein named, the receipt of which is hereby acknowledged, do, by these presents, bargain, sell, release and forever quit-claim unto the said Jackson County, its successors, and assigns, all our right, title, and interest in and to that certain tract or parcel of land lying in the County of Jackson and State of Texas, described as follows, to wit:
A part of the Ramon Musquiz 5½ league grant being a strip of land 60 feet wide, same to extend 30 feet in a perpendicular distance on each side of a line running as follows: Beginning on south line of land the property of Robert Haynes, said point being N 35° W 1,113 varas (1,030.5 yards) from the center of the north end of Garcitas Street as said street is shown and laid off by map or plat of the Town of Vanderbilt;
Thence from said beginning point N 37-3° W 2,324 varas (2,151,85 yards) passing through Robert S. Haynes land and the land of Michael C. Whalen, Mark and Lorraine Whalen to lower corner of land of Richard D. Haynes, being a common corner with land of Will Owens and wife Blannie Owens;
Thence on in same direction along the line dividing the lands of said Richard Haynes from that of said Blannie Owens and husband Will Owens to the NE corner of Blannie Owens and NW corner of Richard Haynes, on the south line of Burns Ranch, now the property of E. R. Hagist, trustee;
It being our intention to convey hereby to Jackson County a strip of land 30 feet wide on each side of the line above described, it being expressly agreed that the grantee, Jackson County, will within one year from this date, build a good three-wire fence with posts not further than 15 feet apart along both lines or sides of the road herein conveyed, said fencing on the part of the County being the real consideration for which this deed is made.
To have and to hold, the said premises, together with all and singular the rights, privileges and appurtenances thereto in any manner belonging unto the said Jackson County, its successors and assigns, forever, so that neither we the said Will Owens, Blannie Owens, Richard Haynes, Mark Whalen, Michael C. Whalen nor Lorraine Whalen, (nor Robert S. Haynes, omitted) nor our heirs, nor any person or persons claiming under, shall at any time hereafter have, claim or demand any right or title to the aforesaid premises or appurtenances, or any part thereof.

Before me, W. W. McCrory, a Notary Public, in and for the County of Jackson, in the State of Texas, on this day personally appeared M. C. Whalen, for himself and as Guardian of Lorraine Whalen, and Mark Whalen for himself and Richard Haynes for himself, known to me to be the persons whose names are subscribed to the foregoing instrument, and acknowledged to me that they executed the same for the purposes and consideration therein expressed, and in the capacity therein stated and set forth.
