Book B, Page 446 Thomas Haynes buys 354 acres in Jackson County
August 2, 1845
THIS INDENTURE made and entered into this 2nd day of August A.D. 1845, between Hamlet Ferguson of Lavaca Texas, of the one part and Thomas Haynes late of New Orleans of the other part
WITNESSETH: that in consideration of the sum of three hundred and fifty four dollars in hand paid the said Ferguson hath this day and does by these presents bargain, sell, alien, and convey unto the said Haynes two several tracts or Labors of Land situate and being in the Republic of Texas, in the County of Jackson on Lavaca river
The one Granted to Sam P. Middleton by Patent dated 29th March 1841, being a part of his head right above the Atuscasito (Atascosita) Road on the East side of the River
Beginning at a stake on a prairie bluff at the River bank the S. West corner of A.M. Clare’s survey from which a live oak (missing) inches diameter marked X bears S 62 East 20 varas and another oak in a thicket marked X bears N. 20 E 10 varas;
Thence N. 84° 30 East 2,220 varas to a small Spanish Oak for corner from which a Post Oak 14 in. diameter marked X bears South 31 West 7 varas another post Oak 12 in diameter marked X bears N. 42 E 8 varas;
Thence S 5° 30 East 500 varas to a Black Jack on the point of a dry branch for corner from which a Post Oak 12 in diameter marked X bears South 7 E 8 varas another Post Oak 10 in diameter marked X N 30 E four varas;
Thence S 84° 30 W 1,660 varas to the river bank at a stake on a prairie bluff seven varas above a hollow in the bank from which a Pecan marked X bears S 34 E 133 varas;
Thence with the meanders of the river to the place of beginning, containing one half Labor or arable and one half of pasture land which was conveyed by deed from said Middleton and wife to A.M. Clare on 13 March 1843, as per deed recorded in the proper office of Jackson County.
The other is one Labor or one million square varas of Land situated on the same County and on the same river (and adjoins the above tract) and was granted to A.M. Clare by Patent dated 17th November 1841, and begins at an Elm marked A.C. on the bank of the River from which a hickory marked X bears South 47 E another Hickory marked X bears N. 65 W 4 varas;
Thence N. 84° 30 East at 670 varas the road by Rocky Ford at 1150 varas a Spring branch at 2,223 varas a stake from which a Post Oak marked X bears S 15° W 5 varas;
Thence South 5° 30 E 500 varas to a Black Jack for the corner on the bank of a large Run, from which another Black Jack on Sam P. Middleton line bears N 25 W 12 varas;
Thence with Middleton’s line S 84° 30 W 1,780 varas to a stake on prairie bluff from which a live Oak marked X bears S. 62 E 2 varas and another live oak marked X N. 20° E 10 varas;
Thence with the meanders of the river to the place of beginning.
These two surveys contain one hundred and seventy seven acres seach and are one half arable and one half pasture land and this last tract was conveyed by the grantee Clare to Hamlet Ferguson by deed dated 25th day of June 1845, the other tract was conveyed by said Clare to said Ferguson by deed dated same day and both recorded in the proper office of Jackson County, Texas.
To have and to hold the said two above described Labors of Land with the appurtenances to the said Haynes his heirs and assigns forever. And the said Ferguson doth for himself his heirs &c covenant to Warrant and defend the said two tracts of land with the appurtenances aforesaid against himself his heirs and all others for ever by these presents.
In testimony whereof the said Ferguson hath hereunto set his hand with scroll for seal the say and year aforesaid.
