Know all men by these presents that I, Celia A. Haynes of the one part and first party, and Christopher Haynes of the other part and second party, all of said county and state, for and in consideration of the love and affection I, the said Celia A. Haynes, have for my son Christopher Haynes, and also the sum of one dollar, lawful money of the United States, cash to me in hand paid by him the said C. Haynes, at and before the signing and delivery of these presents, the receipt thereof is hereby acknowledged, have this day given, granted, bargained, sold, conveyed and forever quit claimed and do by these presents give, grant, bargain, sell, convey and forever quit claim unto him the said C. Haynes, and to his heirs and assigns, all and singular, that certain piece, parcel or portion of land, designated and described as follows, to wit:
The lower undivided half of a tract of land sold and conveyed by Daniel Haynes to said Celia A. Haynes on the 6th day of July A.D. 1860, containing twelve hundred and eighty (1,280) acres, and which is more particularly described by metes and bounds as follows:
Beginning on the river Lavaca, at the mouth of a ditch near the place where Platt’s Steam Saw Mill formerly stood;
Thence with said ditch (a straight line) to its termination near the base of a sand mound;
Thence southwardly (should be “southwestwardly”, according to original deed from Thomas Haynes to Daniel Haynes, Book E, page 626) to a small mott on the bluff;
Thence pursuing the same course that a line at right angles will intersect M. Stanton’s upper line, and with that line to the river;
Thence up the river to the place of beginning, will include the area of said twelve hundred and eighty across of land, the same being a portion of the Musquez (Musquiz) grant, and the same conveyed by Thos. Haynes to said Danl. Haynes.
To have and to hold the said undivided lower portion of said land which will include the quantity of six hundred and forty (640) acres, more or less, unto him the said C. Haynes, and to his heirs and assigns forever, together with all the rights, ways, privileges, improvements, buildings, and appurtenances to the same belonging, free from any and all claims of her, the said C. A. Haynes, her heirs or legal representatives, in fee simple forever.
And it is distinctly understood between the parties that the said land is to be equally divided so as to give to each half of said tract an equal portion of what is called the river bottom.
In witness whereof, she, the said C. A. Haynes has hereunto set her hand at the County of Jackson, Texas, this 18th day of November A.D. 1875.
