Know all men by these presents that I, John M. Smith of the County and Republic aforesaid, for and in consideration of the sum of one thousand dollars to me in hand paid by Thomas Haynes, the receipt whereof is hereby acknowledged at and before the sealing of these presents, have granted, bargained, sold and released, and do by these presents grant, bargain, sell and release unto the said Thomas Haynes, an interest consisting of one undivided fifth part of a certain tract or parcel of land lying and being in the County and Republic aforesaid on the west side of Lavaca Bay, containing one thousand acres, being the same land purchased by the said Smith at a probate sale of the Estate of Thomas M. Connell, deceased, by deed bearing date the fifth day of November 1844, and which is more particularly described and bounded as follows, to wit:
Beginning at the North corner of the Town of Port Lavaca according to the Map of said Town drawn by H. L. Upshaw in the year 1842, running thence S 32° E 1,513 varas; thence N 58° E to the margin of the Lavaca Bay, which above part bears the same proportion to the part of the said half League as 1000 to 2214; thence on a South Western course and parallel to the South Eastern boundary line of said town tract to the South West boundary line of the Survey of the said half League; thence N 60° West with the said Survey to the West Corner of said Town; thence with the North West boundary line of said Town to the beginning, including the whole of said town of Port Lavaca except such lots as were sold by Thomas McConnell (the former proprietor thereof) in his lifetime, together with all and singular the Rights, Members, Ways, Water Courses privileges here described? and appurtenances to the same belonging or in any wise incident or appertaining; to have and to hold the one undivided fifth part of all and singular to the premises aforementioned and described unto the said Thomas Haynes, his heirs and assigns forever, in fee simple, and I do hereby bind myself, my heirs, executors and administrators to warrant and forever defend the said undivided fifth part of all and singular the above described premises unto the said Thomas Haynes, his heirs and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof.
In witness whereof I have hereunto set my hand and affixed my seal this the fifteenth day of December in the year of our Lord One Thousand Eight hundred and forty four.

Before me, James Ingram, Clerk of the County Court in and for said County, personally appeared Jesse O. Wheeler, who being duly sworn deposeth that John M. Smith signed and acknowledged the foregoing deed of conveyance in his presence for the purposes therein contained.
In testimony whereof I hereunto set my hand and seal of the County Court in office at Victoria this 22nd day of December AD 1844.
