Book Q, Page 591 Mollie A. and Annie C. Haynes Sell 213-1/3 acres to George Menefee

Note: Christopher Haynes had three children: Robert S., Amos C., and Mollie A. His wife was Annie C. His mother, Celia A., gave him 640 acres in 1875 (see book H, page 223). After he died, Annie indirectly gave the land to her three children and the land was sold in three separate transactions. But the original survey was in error. So after a new, formal survey, Celia re-gifted the 640 acres to them with proper metes and bounds (see Book Q, page 361). Amos C. (and Annie) sold his one-third to George Menefee on July 12, 1892 (see Book Q, page 364) for $666.66.
This deed is confusing. It states that Mollie A. (and Annie C.) are selling 640 acres to Menefee, whereas they are actually selling only Mollie’s one-third, or 213⅓ acres, although they are giving up their interest in all 640 acres. The description is of the full 640 acres. This confusion is essentially clarified in the immediately following deed (Book Q, page 593) from Robert S. Haynes to Menefee, which points out that Mollie and Annie (and Amos C. previously) had sold only 426⅔ acres, and that he was selling his interest in that 426⅔ acres to Menefee for $1; however, his deed clearly describes the 213⅓ acre tract that Robert S. was keeping for himself. He later sold that land to James O'B. Young on September 11, 1909 (see Book 14, page 579).
Notice that Menefee paid $666.66 for the land. He was essentially paying $2,000 per section of land, but was getting only ⅓ of a section, so he paid ⅓ of $2,000, or $666.66.

Know all men by these presents: That we, Mollie A. Haynes (being one of the heirs at law of C. (Christopher) Haynes, deceased) and Mrs. Annie C. Haynes (mother of said Mollie A. Haynes) of the County of Bee and State aforesaid, for and in consideration of the sum of six hundred and sixty-six 66/100 dollars ($666.66), to us in hand paid by George Menefee, the receipt of which is hereby acknowledged, have granted, sold, and conveyed, and by these presents do grant, sell, and convey unto the said George Menefee of the County of Jackson and State of Texas, all that certain right, title, and interest which we the said Mollie A. Haynes (as daughter of said C. Haynes, deceased) and Mrs. Annie C. Haynes (as wife of said C. Haynes, deceased) have in and to the following tract of land, situated and being in said County of Jackson, State of Texas, to wit:
A part of the Ramon Musquiz (or Musquez) leagues:
Beginning at the NE corner of a survey of 612 acres of land sold by Wm. M. Sanford to George Menefee on the west bank of the Lavaca River;
Thence S 50° W (no variation) with the NW boundary line of said survey, at 1,040 varas a large post oak tree marked (X over three hacks, or horizontal bars), at 2,140 varas (1,981 yards) a stake and corner of fence (and NW corner of said survey);
Thence S 44¼° W with said Menefee fence and line 1,910 varas (1,769 yards) to a stake in same;
Thence N 40° W 1,091½ varas (1,011 yards) to a stake in prairie;
Thence N 50° E 3,596 varas (3,330 yards) to a stake on the west bank of said Lavaca River, from which a live oak 16 inches in diameter marked X bears S 34¾ W 130 varas;
Thence down the meanders of said river to the place of beginning, containing six hundred and forty (640) acres.
(And the said Annie C. Haynes, as the natural guardian of the said Mollie A. Haynes hereby declares that this sale of the above described land is necessary in order to support, maintain, and educate the said Mollie A. Haynes, this being the only property or estate of said Mollie A. Haynes available for her support and education.)
To have and to hold the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging unto the said George Menefee, his heirs and assigns forever, and we do hereby bind ourselves, our heirs, executors, and administrators to warrant and forever defend, all and singular, the said premises unto the said George Menefee, his heirs and assigns against every person whomsoever lawfully claiming or to claim the same, or any part thereof.
