Book O, Page 629 Amos W. Haynes Trades 700 Acres for 770 Acres
with His Daughter, Mary Julia Haynes Whalen
Note: Amos W. Haynes originally sold 700 acres of his Haynes place land to his oldest daughter, Mary Julia Haynes Whalen, as recorded in Book N, page 103. But here, that deal was effectively reversed when he gave her 770 acres of land he owned in the Juan Fernandez Grant in exchange for his original 700 acres of Haynes place land. This is the deed for the 700 acres; a separate deed gives the 770 acres to Mary Julia.

Know all me by these presents that we, M. C. Whalen and Mary Julia Whalen, his wife, of the County of Jackson and State of Texas, for and in consideration of the sum of ten dollars to us paid by Amos W. Haynes of the county and state aforesaid, and for other valuable considerations us hereunder moving, the receipt whereof is hereby fully acknowledged to our full satisfaction, have bargained, sold, and reconveyed, and by these presents do grant, bargain, sell, and reconvey unto the said Amos W. Haynes, all that certain tract of land described as follows, to wit:
The lower half of fourteen hundred (1,400) acres of land out of the tract of five and one half (5½) leagues in Jackson County, Texas, originally granted to Ramon Musquiz on the west side of the Lavaca River. The said 1,400 acres is further described as part of the tract of three thousand (3,000) acres known as the homestead place of the late Thomas Haynes, deceased, who was father to the said Amos W. Haynes, the grantor (actually, grantee) herein, and is the upper part of 2,360 acres conveyed to the said Amos Haynes by his mother, Celia A. Haynes, by deed dated on the 21st day of August, 1882, and recorded on page 403 deed book “K” Jackson County records and is that part of said 2,360 acres which remained to the said Amos Haynes after taking there from nine hundred and sixty (960) acres which the said Amos Haynes conveyed to his mother, the said Celia A. Haynes, by deed dated on the 2nd day of April 1883, and recorded on pages 412-413 deed book “K” records of said Jackson County.
The aforesaid half of fourteen hundred (1,400) acres has never been surveyed and separated from the remainder. The above described and reconveyed land was conveyed to Mary Julia Whalen, the grantor herein by Amos Haynes. the grantee herein, on the 13th day of August, 1886, by conveyance of record of page 103 book “N” deed records of Jackson County, and this instrument is intended as a reconveyance of all the title acquired by said last mentioned conveyance.
To have and to hold the aforegranted premises together with all and singular the rights and privileges unto the same belonging or in any wise incident or appertaining unto him, the said Amos W. Haynes, his heirs and assigns forever, and we, the grantors herein do covenant with the said grantee that since the aforesaid land was conveyed to the said Mary Julia Whalen as aforesaid we have done nothing whereby to in any way encumber the same and that we will forever warrant and defend the title to the same unto him, the said Amos Haynes, his heirs, executors, administrators and assigns, against the lawful claims and demands of all persons claiming or to claim the same or any part thereof..
